A Linden driver is the latest person to be charged under the new law relating to driving under the influence of alcohol.
Terrence Da Silva, 51 , a minibus driver of 286 Block 22, Wismar, Linden was not required to plead to the indictable offence of causing death by dangerous driving yesterday, before Acting Chief Magistrate Melissa Robertson, at the Georgetown Magistrates Court.
It was alleged that the accused, on July 26, at Wismar Public Road he drove BHH 7849, in a dangerous manner and caused the death of Winston Tyrone Craig.
Da Silva was also charged with driving under the influence of alcohol. It was alleged that on July 26, at Wismar Public Road he drove the minibus while his blood alcohol level exceeded the legal limit. He pleaded not guilty to that charge, too.
His lawyer in a bail application told the court that his client, a father of nine, has been a driver for the past 10 years. He asked for bail in a reasonable bail.
But Police Prosecutor Denise Griffith objected to bail and stated that the defendant had in an excess of 22 beers in his system. She also asked that the matter be transferred to the Christiansburg Magistrate’s Court.
That application was subsequently granted and the accused is expected to make another court appearance in Christianburg on August 5.
Two other persons were on Monday charged under the new law relating to driving under the influence (DUI).
The persons were found to have been over the legal limit in terms of alcohol, after they were tested with the use of the Breathalyzer following an accident at Turkeyen, East Coast Demerara, on Saturday last.
Bachan Balram, of Cummings Lodge, ECD, and Sheik Hanif, of Industry, ECD, were charged accordingly and appeared before Magistrate Yohhahnseh Cave at the Sparendaam Magistrate’s Court on Monday. They pleaded guilty and were each fined $7,500.
The two drivers escaped serious injury when their speeding cars came into contact on the Rupert Craig Highway approximately 300 metres from the University of Guyana Access Road on Saturday morning.
