Proceedings in the review of the order by Appellate Judge, Justice B.S. Roy, to stay the sale of property belonging to the embattled Colonial Life Insurance Company Limited (CLICO) was halted yesterday when one of the sitting judges recused herself from the hearing.
Kaieteur News understands that Appeal’s Court Judge, Yonnette Cummings-Edwards, who was to have sat with Acting Chancellor of the Judiciary, Carl Singh, and another judge from the High Court pulled out of the case citing connections to the insurance company.
Justice Cummings-Edwards indicated to the court that she cannot be a part of the review since she is a policy holder with the company and it would amount to a conflict of interest.
The company’s new Judicial Manager, the Bank of Guyana, had moved a motion to satisfy an order by Justice Roy staying the sale of CLICO’s property.
This was after Chief Justice Ian Chang had earlier ruled that the company’s asset be sold.
According to a source, there are only three Appeal Court Judges in the persons of the Chancellor, Justice Roy, and Justice Cummings-Edwards.
With the pulling out of Justice Cummings, the matter was left in limbo.
But some legal sources say that Justice Roy can still hear the matter.
The source explained that should two High Court judges sit in the matter along with the Chancellor, it will amount to a full court hearing.
The matter will come up again on Wednesday when a decision is expected to be made on how to proceed.
