Leroy Pitt and Andrew James were both remanded on Wednesday when they appeared before Acting Chief Magistrate, Melissa Robertson, to answer larceny charges.
Between July 18 and July 19 both men stole from Toolsieram Persaud one 400-gallon water tank. They pleaded not guilty to the charges.
While both men provided addresses at which they claim to reside, the Police Prosecution insisted that they both had no fixed place of abode.
In his defence, James told the court that on the night in question he saw the tank in a trench close to the virtual complainant’s home and was trying his best to remove it when a police patrol vehicle rolled up beside him.
He said that he explained to the ranks that he was only trying to get the tank out of the trench, but they ignored his story and arrested him.
Pitt said he was walking in the area and James, who he knows well, called out to him for assistance in retrieving the tank from the trench to which he complied.
He said he soon regretted his actions since he was also arrested in the act by the police and taken into custody along with James. The tank they were so busy trying to remove from the trench was also taken by the police.
Persaud said that he recently built a house in Kitty and had installed two water tanks on the premises. He said that he had posted a male security at the home, and that both men pounced on the location while the security was not on sight.
He added that he was reliably informed that the men had emptied the water from the tank into his yard and had made off with the booty when they were intercepted by the police.
They man said that he had also lost several other items at the location since he had built the house.
The men were refused bail and will return to court on July 29.
