…denounces claims as speculative, frivolous and vexatious
Clive Lloyd, former Guyana and West Indies Test Captain, has moved to the courts to challenge a $9M lawsuit filed against him by a contractor Kailie Ramjohn who had sued for breach of contract.
Ramjohn is claiming $9,556,798 as money being an amount due, owing and payable by Lloyd for the construction work done on a two-flat apartment complex at Lot 150, Crown Street, Georgetown.
The Plaintiff claims that he entered into the contract to construct a new two-flat residential apartment building for $35 million.
Ramjohn is of the view that during the process of the construction, Lloyd ordered, authorized and approved additional works to be done on the building.
These included works that were excluded from the contract that formed the total cost to complete the project.
In the end the final cost was $45 million. Ramjohn claimed that he only received $36.9 million.
Lloyd in a writ filed by his power of attorney, Ronald Austin, is denying the claims made by Ramjohn adding that the contract price for the complete works set out in the contract
dated November 27, 2006, is for the sum of $35M and not $45M as is claimed by the plaintiff.
The legal document filed by Lloyd denies that he or his power of attorney, Austin, ordered any additional work or upgrades to be done as alleged by the plaintiff.
According to the legal document filed by Lloyd, at the time the building in question was handed over to him, Ramjohn made no demand for payment for additional work or upgrades or for variation of the written contract.
It was pointed out that Ramjohn’s demand came at a subsequent date. “The plaintiff’s claim is speculative, frivolous and vexatious and an abuse of the process of the Court and should be dismissed with costs,” according to Lloyd.
