The case against Buddy’s International Hotel owner, Om Prakash Shivraj, has not been dismissed. In fact, there have been moves to settle the outstanding monies owed to the Guyana Power and Light Company.
In a release issued yesterday, the electricity company stated that contrary to reports carried in some sections of the press, GPL intends to ensure that all monies owed by Shivraj are paid in full.
Stabroek News of April 8 reported that Guyana Power and Light had its claims for $58 million against Buddy’s dismissed.
The power company stated yesterday that on February 18 last, the action against Buddy’s was called in court and counsel for the defendant confirmed to the court that his client had agreed in principle to settle the GPL claim.
On that instance, the power company stated, the court adjourned the case to March 18 for terms of settlement to be prepared by the parties and given to the court.
However, the matter did not appear on the Commercial List.
According to GPL, the counsel for Shivraj nevertheless appeared before the court after the Commercial List ended, but did not inform the court that GPL had already delivered to him draft terms of settlement.
He also did not report to the court, the company said yesterday, that he had not responded formally to GPL. The court therefore dismissed the claim. When the court was informed by GPL’s lawyers of the position, the court recalled its order, and rendered the action extant.
The case will be called again next Tuesday in the Commercial Court.
It was reported in one section of the press that the two cases in which GPL sought orders for Shivraj to pay $58 million for the supply of power have been dismissed for want of prosecution.
According to that report, the cases were heard in part by Justice James Bovell-Drakes and by the present Commercial Court Justice Rishi Persaud, who dismissed both suits on March 18 last for want of prosecution.
