Businessman, Deodat Singh, was successful in his bid to secure several orders from the High Court against members of the Committee of Management of the Everest Cricket Club after alleged misconduct on his part.
On Monday, Justice William Ramlal granted an injunction against the President of the Everest Cricket Club Rajesh Singh; the vice president, Mark Singh; the secretary, Lalta Gainda; assistant secretary, Salim Baksh; Treasurer, Nyron Hack; as well as committee members Neil Singh; Maniram Shew; Carmachand Rambarran; and Reaz Hussein.
The judge granted an injunction restraining the Everest executive, their servants and/or agents and each and everyone of them from proceeding to hold a Committee Meeting that was fixed for Tuesday, for the purpose of examining any charges against Deodat Singh in connection with or incidental to any alleged misconduct which purportedly took place on the evening of March 6, 2009.
It was also ordered that the executive be restrained from holding any other meeting for the purpose of examining any charges against Deodat Singh until after the hearing and determination of a Summons in this cause.
The matter will continue on April 7, next.
Justice Ramlal made the orders after hearing an application by Singh’s attorney, Anil Nandlall.
Singh’s application to the court states that he is a Life Member of the Everest Cricket Club.
According to the document, during the last 47 years no complaint was ever laid or made against Singh and as far as he is aware he has never been accused or found guilty of any infraction of any Rules and By-Laws of the said Club.
The application added that on the evening of March 6, 2009, a softball cricket match was held at the Everest Cricket Club, under floodlights, between two teams, neither being a team from the Everest Cricket Club.
“I was present at the Club prior to the commencement of the said cricket match and parked my vehicle, as I am entitled to do as a member, on a lawn tennis court located within the confines of the Club’s premises and which has been used as a parking facility over the years.”
“At 21:00 hours every day I am required to take a quantity of medication which I store at home. At or about 20:30 hours, I attempted to leave the Everest Cricket Club for home for the purpose of taking my medication but realized that my egress from the compound was blocked by another vehicle.”
According to the application, Singh “made diligent efforts to locate the driver of the said vehicle but was unable to do so and attempted to secure the cooperation of a disc-jockey who was playing a music system at the said premises to make a public announcement for the driver of the car which was blocking my vehicle to remove his vehicle to allow mine egress from the compound.”
“Again, my efforts were futile because the said disc-jockey refused to make the said announcement. I then attempted to walk onto the field in order to seek an audience with Rajesh Singh,
