Dear Editor,
This letter is in response to an article in Kaieteur News, captioned “Teen Freely Engaged in Sex with Homosexual”.
The details of the story are so ghastly, I hardly know where to begin. The article asserts that neither participant is likely to face criminal charges because they “both admitted to performing the illegal sex act”.
How could a 15-year-old legally agree to engage in any type of sex? Isn’t the age of consent in Guyana 16 years? A 15-year-old does not possess the legal capacity to consent to any type of sexual encounter, therefore, legally; the 15-year-old has been sexually assaulted.
It is of no significance who initiated the sexual encounter or what roles either person played; it is illegal sexual assault of a minor. It is simply stunning to those of us reading this kind of logic outside of Guyana that this could occur. Adults are always the responsible parties in their dealings with minors; no exceptions. It is difficult to understand how a child, 15 years old, who is ineligible to vote, or drive, or marry could be eligible to consent to sexual activity. What is happening in Guyana?
The article also stated that both the adult and the child “underwent medical examinations”. Which civilized society examines adults to ascertain whether they engaged in sexual activity and what form do those examinations take? This is simply unbelievable. The only time an adult should be medically examined after an involuntary sexual encounter is to determine whether that adult was raped. The only person who should have undergone a medical examination is the child, to determine whether he was sexually assaulted. If the child was not penetrated, then the sexual assault must be established through an interview.
Further, how could a minor who lacks the legal capacity to leave his parents’ home decide that he wanted to stay at the residence of his abuser? If an adult harbors a minor at their place of residence without their parents’ permission, that is illegal. This state of affairs is simply unbelievable.
