The preliminary inquiry for sedition accused, Oliver Hinckson, was to have continued yesterday in the Georgetown Magistrates’ Court, but it was further delayed because of the late arrival of lead attorney Nigel Hughes among others.
When the case was called before Acting Chief Magistrate Melissa Robertson the defendant, Oliver Hinckson, was present as usual awaiting the arrival of any lawyer from the host that he has.
Also present were Special Prosecutor Sanjeev Datadin and witness Suraj Singh.
Datadin told the magistrate that he was prepared for a rebuttal between the prosecution and defence after the matter was adjourned on the last occasion, but would have to change this since there were no lawyers present.
The case was put down for a 10-minute break by the magistrate for the arrival of the lawyers. Attorney-at-law Gregory Gaskin then came and made an appearance for the accused.
The lawyer asked for a later date for the defence to reply to submissions proffered by Prosecutor Datadin.
Sanjeev Datadin, on the previous occasion, had to seek an adjournment to refresh the memory of the witness available for the defence.
The argument had occurred after lead attorney Nigel Hughes had argued about the fact that the prosecution could not solicit evidence from the witness. Hughes had further explained to the court that witness would only be concluding or interpreting what Hinckson said, which could be totally different from what Hinckson actually meant.
After the matter had been fixed for March 13, lead attorney Nigel Hughes then came and informed the court that he was before Chief Justice Ian Chang, and did not anticipate to be so late.
The lawyer then asked to be reviewed about what was said in his absence. The lawyer said that since the last date he had only received one “case file” which Datadin said he would have made available.
The matter is expected to be called on March 16.
