Hinckson’s bail slashed by $200,000

Sedition accused, Oliver Hinckson, was yesterday granted a reduction in his bail when he made a court appearance before Acting Chief Magistrate Melissa Robertson, yesterday.
Yesterday, as both the prosecution and defence were awaiting the arrival of another key witness, Sergeant Trevor Reid, they were informed by Special Prosecutor Sanjeev Datadin, that Reid was out of the jurisdiction giving evidence in another matter, and that he could not make the appearance.
Lead attorney, Nigel Hughes, said that he was not opposing bail, noting that the delay pushes back the anticipated date for the completion of the preliminary inquiry. Hughes further told the court that he must make an application on behalf of his client Oliver Hinckson.
Hughes said that he wished to address the issue of the “amount of bail” which was granted to his client. The attorney asked that a “significant amount of bail should be taken off of the $1M” bail which was granted on September 10, 2008.
The lawyer further told the court that his client, Hinckson, has encountered unforeseen financial difficulties and as such he would like a reduction in bail.
However, Prosecutor Datadin objected to this application. He told the court that the bail amount was already fixed and if there was an objection Hinckson’s lawyers should have opposed it from the inception.
He further noted that the bail was paid and there is no need for a reduction. Datadin also told the court that bail should not be reduced because Hinckson has strong ties to the United States.
Hughes rebutted that this is not a case of Hinckson fleeing the jurisdiction, because he was granted “leave” by the Chief Justice Ian Chang. The lawyer further explained that he returned on the stipulated date which demonstrates his capacity to return.
Hinckson’s bail was reduced by $200,000 and the accused is expected to make his next court appearance on January 29.
