…Chief Justice had ordered him released
In a twist of events, embattled businessman Barry Dataram was ordered released on Wednesday, after an Order Nisi was made absolute in the High Court by Chief Justice Ian Chang and Justice William Ramlal. The defence was also awarded $25,000 cost.
However, Dataram got only a few hours of freedom, as another judge granted a “stay of execution” which resulted in Dataram’s rearrest on the Providence public road.
According to attorneys for Dataram, Crime Chief Seelall Persaud had informed them that a “judge had granted a stay of execution”.
But the Chief Justice had denied a stay of execution when it was proposed by Attorney General Doodnauth Singh on Wednesday.
Lead attorney Vic Puran said, “If a judge indeed granted that order, we would immediately mount a challenge it.” On Wednesday, the lawyers had said that the Minister of Home Affairs had no authority to permit an extradition hearing.
Dataram’s lawyers have filed an appeal at the Guyana Court of Appeal, which will hear the matter on Tuesday.
Following his arrest, the businessman was taken to the Brickdam police lockups, where lawyers were trying to ascertain the reason for his arrest. They were told by police ranks that the police were acting on “a stay of execution”. Another officer said that Dataram had again breached a court order.
Dataram came under the radar after his wife and child had being kidnapped last year by two Venezuelans. He was arrested, but was later released after the stipulated time of detention had lapsed.
Barry Dataram was held earlier this year on a provisional warrant of arrest, pending extradition proceedings which were requested by the United States of America. Reports are that Dataram was indicted in the USA on drug-related charges, but fled the jurisdiction.
He was arrested two times prior on provisional warrants issued in the Magistrates’ Courts, but managed to secure his release on an order of the High Court.
