Sherwin Joseph, 29, of Lot 17-7 Charlotte Street, New Amsterdam, and Quacy Welcome, 22, of MNDC Housing Scheme, New Amsterdam, were yesterday granted $400,000 bail after they made their court appearance before acting Chief Magistrate Melissa Robertson on a charge of receiving stolen property.
It is alleged that the two, on November 22 last, at New Amsterdam, received one motor car valued at $2.4 million, knowing the vehicle was stolen or unlawfully obtained. The car is the property of Cecil Carter.
They were not required to plead, and were represented by attorneys-at-law Patrice Henry and Gregory Gaskin.
Henry, who appeared for Joseph, told the court that his client has an unblemished record and that there was no evidence to substantiate the charge. The lawyer further told the court that bail should be granted in a reasonable sum.
Attorney-at-law Gregory Gaskin, who represented Welcome, said that his client is a “complete stranger to the crime.” He added that Welcome poses no flight risk and would return to court once he is admitted to bail. Gaskin said that the prosecution must take into consideration that the evidence must be established before, so that the charge can stand up.
Police Prosecutor Sherwin Matthews objected to bail. He said that there are other charges that would be instituted against the accused shortly.
He added that the vehicle was recovered and photographed, and advice was given by the DPP about the case.
At this point, both lawyers interjected and told the court that their clients had being in custody since last Thursday. They added that four basic criteria must be covered by the prosecution when objecting to bail. These are, “The gravity of the offence, whether the accused would tamper with witnesses, would they repeat the offence, and if they pose a flight risk.”
Attorney-at-law Gaskin said that none of these criteria has being addressed by the prosecution. He added that, if bail is denied, they would be denying these “young men” their rights.
Police Prosecutor Sherwin Matthews said that he had received word from the investigating ranks that the two are wanted in connection with “armed robbery.”
Attorney Gaskin said, “Your Worship, the prosecution is making your court into a fish market, because they’re only fishing for clues.” He added that the prosecution needed to stop and investigate the matter properly.
Bail was granted, and the accused are expected to make their next court appearance on December 19. The matter was also transferred to the New Amsterdam Magistrate’s Court.
