Dear Editor,
My first letter probably was not very clear on this issue, so let me attempt to clarify.
The law of resignation requires clear and unequivocal action or statements demonstrating an intention to voluntarily leave and my assumption is that such intention was clearly stated by Uncle Adam because he was not comfortable working with the PPP administration.
It is also premised on the fact that Uncle Adam said he resigned in the public interest so it is reasonable to assume that he did so on his own initiative and not necessarily on the behest of the PPP.
I maintain that if he did resign voluntarily and a promise to pay benefits was given by Uncle Ulric, then the PPP should not be held accountable since the claim had no legal basis.
It is my understanding also that pension and/or gratuity is paid at retirement, not resignation, and upon the attainment of certain age. I do not know that Uncle Adam was that old 16 years ago.
I re-iterate, if it can be proved that the PPP compelled, forced or gave Uncle Adam an ultimatum to resign, then he should be paid all his legal entitlements.
I would be the last person to support any injustice against Uncle Adam since I recovered millions of dollars for employees against defaulting employers during my tenure of employment as a labour officer. Testimony to this can be obtained at the Ministry of Labour.
Finally, I cannot fathom anyone having a bona fide claim will allow it to fester for 16 years, or an organisation such as the government will allow this to happen if the claim was valid.
