Azaad Hussain and Tarran Persaud Piaralall, of Non Pareil, East Coast Demerara, were both granted bail in the sum of $1million after they made their first court appearance before Acting Chief Magistrate, Melissa Robertson.
It is alleged that the two, on August 13, last, in the vicinity of Old Road Eccles, East Bank Demerara, had in their possession a quantity of illegal petroleum, to wit diesel, which did not contain the marker in the required proportion as determined by the Minister.
They pleaded not guilty.
Appearing on behalf of the GEA was attorney at law Anil Nandlall and representing the two defendants was attorney at law Khemraj Ramjattan.
In a bail application, Mr. Ramjattan requested that the defendants be sent on their own recognisance.
The lawyer pointed out to the court that $1 million was already lodged by Mr. Piaralall at the High Court.
This happened as a result of legal proceedings which were instituted for the release of the tanker in which the fuel was allegedly found.
Mr. Nandlall interjected and told the court that while he does not oppose bail, the sum must be substantial.
He added that the court must take into consideration the increasing prevalence of these types of offences.
The lawyer further noted that the fuel involved was approximately 2250 gallons of diesel with a street value in excess of $10 million.
Mr. Nandlall further argued that the High Court proceedings were irrelevant to the charge in the Magistrates’ Court since those proceedings concerned the release of the fuel tanker. Hussain and Piaralall are expected to make their next court appearance on November 10.
