–must wait three months for next hearing
Joseph Phillips, 28, of Lot 129 James and King Edward Streets, Albouystown, was yesterday remanded to prison after he appeared before Magistrate Hazel Octive-Hamilton, yesterday, at the Georgetown Magistrates’ Court.
Phillips, on October 2, reportedly had in his possession 3kg 45grams of cannabis for the purpose of trafficking in narcotics.
Yesterday he pleaded not guilty.
He is being represented by Attorney-at-law Glenn Hanoman, who in a bid to secure bail for his client told the court that Phillips is a father of five minors. He further told the court that Phillips is a distinguished member of the Guyana Fire Service, with eight years of service.
Hanoman also noted that Phillips’s case is an unusual one, since the police had arrested several other persons for this matter, and only his client was eventually charged.
The lawyer noted that this charge was made after the file was sent to the Director of Public Prosecutions.
He added that the apartment in which the defendant lives is occupied by others and that the substance was found in an open yard downstairs.
The lawyer said that he is asking that his client be given his pre-trail liberty since his client does not pose a flight risk.
Phillips was held for five days, which Hanoman described as a grave injustice.
However, Police Prosecutor Desire Fowler told the court that bail should be denied, given that the marijuana was found where the accused and his reputed wife lives. No other occupants live there, Ms Fowler added.
Bail was denied and the accused is expected to make his next court appearance on January 7, 2009.
