The Director of Public Prosecutions has recommended that no charges be laid against Magistrate Gordon Gilhuys for the shooting of a policeman on duty.
Acting Police Commissioner, Henry Greene disclosed yesterday that the file on the matter has been returned to the police with the recommendation that Gilhuys should not be charged.
“I have to see the file, I have to see what the DPP has written, I haven’t seen the file,” Greene stated.
Two months ago Magistrate Gilhuys opened fire on the policeman, Corporal Mark George who was part of a patrol that had stopped to investigate a parked tinted vehicle on Woolford Avenue.
It was reported that the Magistrate and another person was in the vehicle when the uniformed police rank approached it.
George was shot in the right side of his back and the bullet exited the abdomen, but not before damaging a few vital organs, including his kidney.
A decision on whether or not to charge Gilhuys was delayed when the Director of Public Prosecutions (DPP) requested additional information.
When asked why advice was being sought on all the possible charges facing the magistrate, Acting Commissioner Greene had said that the police felt that it would be wise to have an independent office look at the matter.
“We would prefer in matters like these when police are involved that the DPP…albeit, an independent analysis is done and pronounce on it.”
Magistrate Gilhuys had lodged all of his weapons with the police, including the one reportedly used in the shooting.
Police had stated that the weapon used by the magistrate in the incident was one that was loaned to him while he was a member of the force.
The magistrate has not sat on the bench since the shooting and it is still not clear if he will return in light of the recent ruling.
Yesterday the Acting Commissioner told the media that he is unaware of any financial settlement in the matter.
