– delay of trials compounded by Magistrate’s absence
The Guyana Police Force has denied claims made by four capital offence prisoners who had stated that they are denied their court appearances if they don’t pay the passage for the police.
According to a statement from the Force’s Public Relations Office, apart from other duties, the Guyana Police Force seeks to have persons who are placed before the courts have their matters speedily addressed, and disposed of.
In the meantime, this newspaper has been reliably informed that one other factor which has been contributing to the delayed trials for the four prisoners as well as others is the absence of a Magistrate at the Anna Regina Magistrate’s Court. The four men, Dyal Singh of Supenaam, Jainait Lall of Devonshire Castle, Rajesh Rahaman of Anna Regina, and Petamber of Queenstown, all murder accused, had told Magistrate Priya Beharry during a recent court appearance at the Georgetown Magistrates’ Court that they are not being taken to the Anna Regina Court as they should be, for their trial. The men further claimed that they are only afforded their trials which are all taking place at the Anna Regina Magistrate’s Court if they pay the passage for the police ranks escorting them.
Meanwhile, checks on the Essequibo Coast have revealed that currently there is no presiding Magistrate at the Suddie, Charity or Anna Regina Magistrates’ Courts since early August.
This newspaper was told that the presiding Magistrate should be Ms. Faith Mc Gusty. However, since her last court date which was August 7 she reported sick.
In addition, prior to Ms McGusty being assigned on the Coast, there was no Magistrate presiding at the courts for at least two months.
Magistrate Maxwell Edwards was the presiding Magistrate up to February 7 of this year and had been the presiding Magistrate for four years before leaving in February. Edwards reportedly came off the bench after reporting ill as well.
After that Magistrate left, the Essequibo coast was without a presiding Magistrate for at least two months which meant prisoners who had pending cases were placed on further remand.
– Meanwhile, as it is now, the Suddie and Anna Regina Magistrates’ Courts sit weekly, while the court at Charity sits once a month. Over at Leguan and Wakenaam, the court sits once a month.
