— Company breached agreement
Magistrate Krishndat Persaud has sued Geddes Grant (Guyana) Limited for in excess of $1M for breaching an agreement that the company made with him. This newspaper understands that the summons was served on the company yesterday, commanding the representatives to appear in the New Amsterdam High Court on July 4.
According to the court document, Magistrate Persaud, who is also a rice farmer and rice miller, and Geddes Grant entered into an oral agreement at No. 57 Village, Corentyne, Berbice, whereby the company agreed to sell, supply and deliver 1000 bags of ‘urea’ (fertilizer). It allegedly failed to do so.
According to the statement of claim, Geddes Grant carries on business both in Demerara and Berbice.
The agreement between the magistrate and the company occurred in or about May 2008, the document said.
It also said that Geddes Grant was to supply the urea at $6,600 per bag inclusive of transportation and Magistrate Persaud agreed to accept delivery at that price.
The document stated that Geddes Grant was to make the delivery on May 27, 2008 but failed to make any delivery.
In early June, it said, the company informed Persaud that its stocks of urea had been exhausted and that it cannot meet the obligation.
“The urea was needed for plaintiff’s (Persaud) 2008 autumn rice crop and to save his crop and thus mitigate his loss, the plaintiff was forced to buy the 1000 bags of urea from Nand Persaud and Company Limited at a price of $8,000 per bag together with transportation cost of $150 per bag,” it stated.
According to the document, Magistrate Persaud paid the contract price to Nand Persaud and Company Ltd and paid the transportation cost. They both amounted to $8.1 million.
“Because of the defendants’ (Geddes Grant) breach as aforesaid, the plaintiff has suffered loss as liquidated damages in the sum of $1.5 million.”
The magistrate is claiming from Geddes Grant liquidated damages in that sum, together with interest and costs.
