Judge to rule on caution statement

Justice Dawn Gregory-Barnes is expected to rule on the admissibility of a caution statement purportedly given to Police by murder accused Junior Barton.

Barton, 31, of 364 Kuru Kuru, Linden/Soesdyke Highway, is accused of killing the mother of his child, Lisa French.

French, 24, was found dead, on September 2, 2004 at around 21:30hrs, behind a daycare centre where she was employed.

The caution statement was allegedly recorded by Detective Sergeant Phillip Bowman, who said he was attached to the Timehri Police Station when he interviewed Barton in relation to the murder.
The officer said that, during his arrest, Barton disclosed that French was stabbed during a fight.
Defence Counsel Vic Puran has since objected to the oral and written statements purportedly made by Barton to the Police.

Justice Gregory-Barnes has already overruled no-case submissions and has instructed Barton to lead a defence in a voir dire (trial within a trial).
State Prosecutor Dionne McCammon has led several witnesses, including Barton’s nephew, Devon Sobers.
Sobers told the Judge and jury that Barton had requested a change of clothes shortly after he noticed blood stains on his shirt.

On the night in question, Sobers said, he was at home, at around 22:30hrs, when he heard someone knocking on the door.

The witness said he switched on the lights and, on peering outside, recognised Barton as the caller.
According to Sobers, Barton told him that he had a problem and needed some money to borrow.
He stated that the accused requested his company to get the money, but on their way, he noticed blood on Barton’s shirt.

“I ask him, ‘wha’ happen to you?’ and he tell me he had a fight with Lisa and her family.”
Sobers said Barton asked for a change of clothes, and left after being given a shirt.
“He left and I never saw him back until the next morning at the Police station, when the Police pick me up,” Sobers recounted.

“They told me my uncle was at the station and they think I should go and see what happen to him.”
The witness said the Police later escorted him back to his house, where they found Barton’s discarded T-Shirt in the yard.

According to him, when he got to the station, Barton was crying and behaving in a hysterical manner.
Police had retrieved a blood-stained knife, believed to be the murder weapon, after a 12-year-old boy found it in a yard.
