A fireman was on Tuesday jailed for 36 months for fracturing a man’s skull during a row at his apartment June, last.
Stephen Wellington, 35, of Lot 599 Section ‘C’ Sophia, Greater Georgetown, had chopped Javon Glasgow to the left side of his head with a knife during a heated confrontation at the victim’s apartment in Charlestown, Georgetown.
Wellington appeared before Magistrate Geeta Chandan-Edmond at the Georgetown Magistrates’ Court.
The incident occurred on June 3, last. The victim lived in the upper flat of the three-storey apartment building and Wellington was visiting his girlfriend on the second floor at the time.
The court heard that Glasgow was carrying a bucket of water when he passed Wellington on the stairway. The bucket fell and some of its contents spilled on Wellington’s clothes.
An annoyed Wellington kicked the bucket down the stairs and an argument erupted between them. The dispute escalated and the two men started hurling glass bottles at each other. One of the bottles hit Glasgow on his chin.
The situation had caught the attention of their landlady who admonished them for the brawl. Glasgow, who had received injuries from the bottle that made contact with him, attempted to leave the building to go to the hospital but Wellington caught up with him on the road.
Wellington armed himself with a knife and attacked Glasgow. He chopped him to the left side of his head causing his skull to be fractured. Glasgow was taken to the hospital where he remained for two days.
The court heard that Glasgow had sustained a fracture to his skull and was in the hospital for two days. He also had lacerations about his face. He received several stitches for the chops he received, and also had to have a CT scan done.
The matter was reported and Wellington was charged for Felonious Wounding.
On July 18, Wellington was taken before the courts and he pleaded not guilty to the charge. He was granted bail in the sum of $100,000. A trial was later conducted before Magistrate Chandan-Edmond.
During the trial, the Prosecution spearheaded by Lance Corporal Jomo Nichols had called upon three witnesses while the defence, led by Attorney-at-Law Clive Forde, had called upon the landlady and the defendant’s girlfriend to testify.
Magistrate Chandan-Edmond who returned the verdict on Tuesday found him guilty.
During mitigation, Forde asked the court to consider a non-custodial sentence or a suspended sentence. He said that his client had been serving the Guyana Fire Service for the past seventeen (17) years and was at risk of losing his job through this “unfortunate situation.”
The lawyer beseeched the court to be lenient with Wellington, a father of one, who had no previous antecedents.
The Police Prosecutor, in his response, asked the court to consider the nature of the charge and the severe injuries Glasgow had sustained and impose a custodial sentence.
