A teenage boy was recently brought before the courts charged with being in possession of an illegal gun and matching ammunition as well as opening fire on a victim during an ambush.
Nigel Norville, 18, of Lot 168 Duncan Street, Georgetown was on Friday taken before Chief Magistrate Priya Sewnarine-Beharry at the Georgetown Magistrates’ Court to answer four charges.
The police claim that on April 29, at Festival City, Norville was armed with a gun when he relieved Marcel Fitzaben of his $150,000 gold chain. They claimed, too, that he discharged rounds at Fitzaben with intent to maim, harm or disfigure him.
It is also alleged that on the same date and place Norville had a 9mm pistol and five matching rounds of ammunition while he was not the holder of a firearm licence.
To all the charges, he pleaded not guilty and submitted an application for reasonable bail through his lawyer, Adrian Thompson, who said that though the charges are grave, his client has no prior convictions or charges neither any pending matters in the courts.
Thompson claimed that the police are trying to “pin” the offences on his client.
“Your worship, my client was beaten by a police officer with the butt of a firearm. The police have a medical certificate which testifies to the injuries he sustained.”
According to Thompson, his client has been held in police custody since Tuesday. “My client was apprehended near the scene of the alleged incident so if it was indeed him, at the time of his arrest he should’ve been in possession of the item the police claimed was stolen but this is not so.”
The lawyer said that Norville was prepared to comply with conditions set out by the court for bail such as lodging his passport and reporting regularly at the police station.
His application however was met with sharp objections from Prosecutor Inspector Michael Grant who explained that on the day in question the victim, who was wearing his gold chain on his neck, was walking along a street in Festival City.
The teen allegedly approached the victim with his gun and demanded that Fitzaben hand over his jewellery.
However, the victim was reluctant and the two then engaged in a scuffle during which he reportedly fired three shots at Fitzaben and made off with his chain.
Grant explained that the group of public spirited citizens who chased and apprehended him later handed over the accused to the party of police ranks who responded to the sound of gunshots.
He stated that whilst the gun with matching rounds was found on him, the stolen chain has not been recovered.
The Inspector urged the court to consider the prevalence of the offence as well as the fact that a firearm was recovered on Norville and to deny him bail.
Inspector Grant argued that the injuries sustained by the accused were inflicted by the group of civilians who apprehended him and not as a result of police brutality.
He assured the Magistrate, however, that he will investigate the allegations made by the defence attorney.
Norville was remanded to prison. The case will be called again on May 23.
